Privacy and data protection policy

Legislation

The protection of personal data is a priority for Bambus House Holidays Rental, (hereinafter referred to as Bambus House). Thus, in accordance with Regulation No 2016/679 of the European Parliament and the Council of 27 April 2016 – General Regulation on the Protection of Personal Data (hereinafter referred to as GRPPD), we would like to inform you of our Privacy Policy. It applies exclusively to the gathering and processing of personal data of our customers and newsletter subscribers (hereinafter referred to by customers), their rights, as well as how they can manage their consents.

What is personal data

Personal data means any information, of any nature and on any media, including sound and image that allows the identification of a person, directly or indirectly, in particular by reference to an identifier, such as name, identification number, location data, electronic identifier, specific characteristics of the person’s physical, physiological, genetic, mental, economic, cultural or social identity.

Data to be collected

As part of our short or medium-term rental activity of holiday apartments, Bambus House will collect and process the personal data necessary for the provision of these services, namely name, address, telephone number, email address, tax payer number, ID/passport card number and, where necessary, credit card details.

Data destination

The personal data of customers are collected and processed by Bambus House, for the following purposes:

  1. Compliance with legal obligations to which Bambus House is subject, including billing of contracted services (Article 6.º n.º 1, b) and c) of the GRPPD);
  2. Communication of data to the SEF (Portuguese Boarder ans Immigration Bureau), which we must comply in the case of foreign customers;
  3. Capturing a deposit and returning it – derived from the commercial relationship between Bambus House and its customers;
  4. For contact purposes, within the scope of marketing strategies of Bambus House, namely, for sending a Newsletter. In accordance with Article 6.º n.º 1, a) of the GRPPD, this consent shall be obtained by optional subscription of the respective written authorization form.

Sharing and legal obligations

Due to legal impositions, Bambus House will share some personal data with other recipients such as DGCI (Portuguese Tax Authorities), SEF (Portuguese Boarder ans Immigration Bureau) and others to whom it may be legally obliged in the course of legal proceedings.

Without prejudice to the legislation, regulations or judicial determination to the contrary, the personal data collected will be kept only for the period necessary for the purposes in question.

Customer/subscriber rights

Pursuant to the GRPPD rules, you may request at in any time from Bambus House:

  1. confirmation that your personal data has been processed and, if so, access to the same.
  2. rectification of your personal data.
  3. the deletion of your personal data whenever:
    1. they are no longer necessary for the purpose of collecting and/or processing them;
    2. the data subject has withdrawn the consent previously given and there is no other legal basis for its maintenance;
    3. the data subject is opposed to the processing and there are no prevailing legitimate interests justifying it.
  4. the limitation of the treatment carried out if one of the following situations is present:
    1. inaccuracy of personal data – until the controller can confirm its accuracy;
    2. Bambus House no longer needs personal data for processing purposes, but is required by the holder for the purposes of declaration, exercise or defense of a right in a judicial process;
    3. if you have opposed the processing, until it is found that Bambus House’s legitimate reasons for handling them prevail over those of the data subject.
  5. the end of treatment. Bambus House will cease the processing of personal data unless it presents legitimate reasons to pursue it that prevail over the interests, rights and freedoms of the data subject, or for the purposes of the declaration, exercise or defence of a right in a judicial proceeding.
  6. the right to data portability. That is, under the law, you have the right to receive the personal data you have provided to Bambus House in an accessible format.

The customer is entitled to revoke the consent for the collection and processing of data previously given to Bambus House. This revocation does not compromise the lawfulness of the treatment already performed or subsequent thereof, imposed by legal obligations to which Bambus House is subject.

The client also has the right to lodge a complaint with the GRPPD if any of the above assumptions do not occur.

In the context of the consent provided by the client, Bambus House may promote actions to disseminate its services through email, SMS, or other service.

If the customer wishes that his/her personal data be no longer processed for marketing, information communications or inclusion in lists of information services, he/she may revoke the authorization for their use at any time. To do so, an email should be sent to Bambus House at marketing@bambushouse.com, demonstrating this claim, or else follow the instructions given at the end of the communications made via email.

Our commitment

In accordance with the Privacy and Data Protection Policy, we strive to keep data safe. However, the transmission of information over the Internet is not completely secure, and we cannot guarantee the absolute security of the information. However, we are committed to keeping the information confidential in accordance with this Privacy Policy and the GRPPD and never to assign, sell or distribute the information for any purpose whatsoever.
